Terms

These terms are the agreement between you and us about Hemmingway: this website, the apps for Mac, Windows and Android, the web app, and the API.

Making an account, or using any of it, means you accept them. If you don't accept them, don't use it.

Who we are

Hemmingway is made and run by the Commons Lab, a small lab in Switzerland. "We" and "us" mean it. You reach us at support@hemmingway.io.

Who may use it

Your account

Give a real email address. Keep your password and your sign-in codes to yourself. Don't let anyone else use your account.

What is done through your account is yours, unless someone got in and that wasn't your doing. Tell us at support@hemmingway.io as soon as you think someone has.

One account is one person. Don't share it, sell it or pass it on.

Plans and payment

The prices are on the pricing page, in US dollars. Stripe takes the payment; we never see your card. Any tax we have to charge is shown at checkout.

A plan renews on its own, every month or every year as you chose, at the price in force then, until you cancel it.

You can cancel any time in Hemmingway's Settings or on the Manage page. Your plan then runs to the end of the period you have paid for and is not renewed. We don't refund the part you didn't use, except where the law requires it.

If a payment fails we try again, and if it keeps failing the account goes back to Free.

We can change prices. A change to a plan you already have starts at your next renewal, and we tell you by email at least 14 days before. If you don't want the new price, cancel before it starts.

Free

Free is a trial, not a plan. What it gives, and for how long, is ours to set and to change.

Codes

A tester code, a promo code or a free period is a favour, not a sale. We can end it, and there is no refund for it.

If you are a consumer in the EU, the UK or Switzerland

You may have 14 days to change your mind about something you bought online. Hemmingway starts working the moment you buy, so when you buy you are asking us to start straight away, and you accept that the right to change your mind ends once we have. Anything the law gives you beyond these terms, you keep.

API credit

Credit is paid for before it is used. It lasts 12 months from the day you buy it. The oldest credit is used first, and what is left of a purchase after 12 months expires.

Credit isn't money and isn't refunded, except where the law requires it.

An API key is a password. Keep it secret. What is used through your key is yours to pay for, whoever used it.

We set rate limits, and we can change them.

Fair use

Hemmingway is priced for one person's own work. We can slow down, limit or stop use far beyond that — automated at scale, shared between people, or resold — and we'll tell you why.

What you may not do

Don't use Hemmingway to:

An account doing any of this can be suspended or ended.

What you write, and what Hemmingway writes back

What you send stays yours. We don't claim it.

You give us the permission we need to run the service, and nothing more: to keep your messages, send them to the model, show them back to you, and have them on the devices you sign in on. We don't train our models on your chats, memory or People, whether they are saved to your account or kept only on your device. The Privacy page says what we keep and for how long.

As far as they are ours to give, the rights in what Hemmingway writes for you are yours. Use it as you like, within these terms.

Two things to know about what comes out:

Hemmingway is an AI

Hemmingway is an AI. What it writes can be wrong, out of date or made up, even when it sounds sure. It can misread what you meant, miss the point of a message, or get a name, a date or a number wrong.

It is given as it is, with no promise that it is accurate, complete or right for any purpose.

Check anything that matters before you rely on it, send it or publish it.

You are responsible for what you send or publish with it.

It is not professional advice

Hemmingway is not a doctor, a lawyer, an accountant or a financial adviser, and nothing it writes is advice from one. Don't use it for medical, legal, financial, tax, safety or employment decisions where a mistake could cause harm. If it matters, ask someone qualified.

Autopilot, your mail and your chats

Autopilot is off until you turn it on.

With it on, for the accounts you connect, Hemmingway reads what comes in, decides what to do under the rules you set, and writes the replies.

Some of those rules send. A rule that answers people you know sends those replies from your account without asking you each time. The rules are yours: you set them, you can change them, and you can turn Autopilot off or disconnect an account whenever you like.

So every message Hemmingway sends is sent as you, and is your message. You are responsible for it, whether you approved it one at a time or set a rule that sent it. Read your rules before you turn it on, and keep an eye on what it does.

It can get it wrong: reply to the wrong message, say something you wouldn't have, write to the wrong person, miss something urgent, or sit still when you needed it to act. As far as the law allows, we are not liable for what it sends, what it doesn't send, or what it gets wrong.

Connecting an account gives Hemmingway access to it. Those services are not ours. Their terms are between you and them, and some of them limit or forbid automated use — keeping to them is yours to do. They can change or cut off that access at any time, and then that part of Hemmingway stops working.

Other people's messages

Reading your mail and your chats means reading what other people wrote to you.

You are saying you may let it. Where the law makes someone answerable for other people's data — the controller, under the GDPR and laws like it — for your mailbox that is you, not us. We handle what reaches us as the Privacy page says.

If someone asks you to stop, stop.

The services underneath

Hemmingway runs on services we don't own: Vercel, Neon, Stripe, Resend, Google sign-in, and a rented machine that runs the model. The Privacy page says what each of them gets.

We choose them with care, but we don't control them, and we are not liable for what they do or for their going down.

Partners

We let approved partners, such as model marketplaces and API platforms, offer the Hemmingway API to their own customers under an agreement with us. The ban on reselling above doesn't apply to them within that agreement. Requests that reach us through a partner are handled as the Privacy page says for the API. What is ours

Hemmingway — the apps, this website, the name and the mark — is ours. You get permission to use the service for as long as these terms are kept. Nothing else passes to you.

Don't copy the apps, take them apart, or work out how they are made beyond what the law lets you do anyway.

The model's weights are a separate thing. Hemmingway-1's weights are released under the CC BY-NC 4.0 licence: anyone may download, run, fine-tune and share them for non-commercial use. Commercial use of the weights needs a separate written agreement with us. Write to luka@hemmingway.io; we are glad to work with anyone who asks. These terms cover the service, not the weights.

If you send us an idea or tell us what is wrong with something, we can use it, free, and owe you nothing for it. Don't send us anything secret.

We change things

We add things, change them and take them away. A feature can be new, rough or short-lived, and anything marked beta or a test should be expected to break.

If a change takes away something you were paying for, you can cancel, and we refund the part of the period you have paid for and not used.

Stopping

You can stop whenever you like: cancel the plan, and delete the account in Settings.

We can suspend or end an account that breaks these terms, where the law makes us, or if the service stops altogether. Unless it is serious or the law is pressing, we tell you first and give you a chance to put it right. If we end it for something that isn't your doing, we refund the part of the period you have paid for and not used.

When an account ends, what we keep for you goes, as the Privacy page says. Download what you want first.

What we don't promise

Hemmingway is given as it is, and as it happens to be running.

We don't promise that it will be up, that it will be quick, that it will be free of mistakes, that it will keep working with any other service, or that it suits what you want it for. There is no promised level of service.

We keep backups, but we don't promise that a chat can never be lost. Keep your own copy of anything you can't lose.

Where the law gives you rights as a consumer that we can't sign away, you keep every one of them.

Where our liability ends

Some of it we can't limit, and don't try to: death or injury we caused, our own fraud, our intent or gross negligence, and anything else the law won't let us limit. That stands whatever else this page says.

Past that, as far as the law allows:

That holds whatever a claim is called: contract, tort, negligence or anything else.

If a claim comes at us because of you

If someone brings a claim against us over what you did with Hemmingway — what you sent, what you published, whose data you let it read, someone else's terms you broke, or these terms — you cover us for the claim and for what it reasonably costs us to deal with it.

This doesn't apply where you are a consumer and the law says it can't.

The small print

If part of these terms doesn't hold up, the rest still does, and the part that doesn't is read as narrowly as it has to be to work.

Not enforcing something once doesn't mean we have given it up.

We can pass these terms on if Hemmingway is sold or reorganised. You can't pass yours on without us saying yes.

Neither of us is liable for what neither of us can control: war, disaster, a supplier going down, a law that changes overnight.

Notices to you go to your account's email address. Notices to us go to support@hemmingway.io.

These terms and the Privacy page are the whole agreement about Hemmingway, and they replace anything said before.

Changes to these terms

We can change these terms. The date at the top says when they last changed.

If a change matters to you, we tell you by email or in the app at least 14 days before it starts. Using Hemmingway after that means you accept it. If you don't, cancel and stop, and we refund the part of the period you have paid for and not used.

The law, and where a dispute goes

Swiss law applies, leaving aside its rules about which country's law to use.

Disputes go to the courts of Bülach, Switzerland.

If you are a consumer, you keep the protection of the law where you live, and you can go to your own country's courts where the law there says you can.
